Toxic Tort and Mold Litigation

Our attorneys have extensive experience in defending companies against toxic tort and product liability claims where a plaintiff claims he or she was injured (or a deceased relative has died) as a result of being exposed to a "toxic" substance. We have represented the entire spectrum of companies confronted with such claims, including product manufacturers, suppliers, distributors, as well as some of the nation's largest property owners and management companies.

Our experience in toxic tort and product liability litigation includes defending corporations in defense of asbestos claims throughout California.  We work with our clients to manage asbestos claims from inception through final resolution, including trial, and focus on cost effective solutions.  Our team has represented a broad variety of clients in asbestos litigation, including manufacturers, distributors, contractors and premises owners.  The diversity of our experience provides us with a broad perspective of the key issues presented in asbestos litigation and allows us to implement effective client specific defense strategies.

We also specialize in the area of indoor air quality and "sick building" syndrome, with a particular specialty in the defense of mold claims. Our attorneys have specialized in mold litigation since these claims began sweeping the nation, and California in particular, in the late 1990's and have defended more than 100 such lawsuits. As a result, we have gained considerable experience in the unique medical and scientific issues involved in this litigation, and have worked both with and against the foremost experts in the areas of allergy and immunology, toxicology, oncologists, industrial hygiene, remediation, and more. We have been highly successful in resolving cases at an early stage as a result of aggressively attacking the pleadings, and have repeatedly defeated fraud and class action claims through demurrers and motions to strike, often leading to dismissal or nuisance value settlements prior to the commencement of discovery. We also have a winning record in pre-trial motions focused on the exclusion of "junk science" expert opinions and causation testimony under the seminal Cottle v. Superior Court decision. As a result of our decade of experience in handling mold claims, we have compiled a comprehensive library of deposition transcripts, research papers, pre-trial motions, and summary judgment motions for the defense of mold claims.

In addition to our litigation work, we also routinely counsel and educate our clients on issues of prevention, development of operations and maintenance plans, mold protocols, insurance, contracts, and the selection of appropriate mold contractors and consultants for remediation and abatement.
